On 16 May 2024, the Official Journal of the European Union published Commission Regulation (EU) 2024/1328. The new regulation revises REACH restrictions on octamethylcyclotetrasiloxane (D4), decmethylcyclopentasiloxane (D5) and dodecmethylcyclohexasiloxane (D6). These restrictions are in addition to the existing restrictions on D4 and D5 in rinse cosmetics under the REACH regulation.

This revision is necessary to address the environmental risks associated with the use of these substances in consumer products, which are ultimately released into aquatic systems and the atmosphere. In addition, the European Chemicals Agency Risk Assessment Committee (RAC) identified cosmetics as the main source of the release of these substances in the environment.

It should be noted that D4 has been included in Annex II of the EU Cosmetics Regulation - the list of substances prohibited from use in cosmetics. Therefore, the new restrictions on the substance will not affect existing cosmetics. 

New limits on D5 and D6 

According to the new REACH regulation amendment, decamethylcyclopentasiloxane (D5) and dodecamethylcyclohexasiloxane (D6) can be used in cosmetics under the following conditions. 

Decamethylcyclopentasiloxane (D5) : 

· From 31 January 2020, the maximum concentration in rinse cosmetics is 0.1% (as applicable); 

· As of June 6, 2027, the maximum concentration in disposable cosmetics is 0.1%. 

Dodecyl cyclohexasiloxane (D6) : 

· As of June 6, 2027, the maximum concentration in rinse and leaveaway cosmetics is 0.1%. 

As a cosmetic manufacturer or brand owner, it is necessary for you to check  whether your product contains D5 or D6 and meets the 0.1% concentration limit, or otherwise reformulate, re-test and re-notify CPNP. In addition, you must ensure that non-compliant products exit the EU market by June 6, 2027. Therefore, good supply chain management is crucial.
